Casual Workers Decision

A groundbreaking decision this week has been given by the Federal Court, ruling that certain casual workers are entitled to paid leave entitlements. This can cause a lot of potential issues for employers that currently employ casual staff.

Casual workers currently receive a 25 percent loading to cover such things as paid leave entitlements in compensation of not being permanent employee (full/part time). This ruling will allow those casual employees, if deemed eligible, to double dip, and receive paid leave entitlements, on top of a loaded payment to cover such.

Millions of dollars could be lost due to undertakings to casuals workers, because of this.

This decision highlights the importance for legislative modification, to provide clarity and transparency for employers and employees. This will prevent any potential issues such as double dipping by casual employees in the future.
