The purpose of this code is to:
- regulate trade in horticulture produce between growers and traders to ensure transparency and clarity of transactions; and
- provide a fair and equitable dispute resolution procedure for disputes arising under this code or a horticulture produce agreement.
The Horticulture code of conduct is enforced and monitored by the Australian Competition and Consumer Commission (ACCC).
Considerations:
Is there still a need for a code, or has it served its purpose, and it should be repealed?
- Does the Horticulture Code provide clarity and transparency in transactions between growers and traders, or a fair dispute resolution procedure?
- What, if any, other objectives should guide the Horticulture Code to improve relations between growers and traders?
Is the Horticulture Code still working as it is intended?
Potential issues in relation to whether the Horticulture Code is operating as intended may include:
- transparency and clarity of trade
- regulatory burden
- fear of retribution
- enforcement, education and mediation.
